  • National Finance Companies

What if my claim is disputed?

In the event that your claim is disputed we are able to guide you through the steps of taking the matter to trial, including advising you on the issues, drafting statements of case, disclosure of documents, drafting witness statements, instructing experts where appropriate, dealing with your opponent and preparing your matter for trial.  We can also represent you at court or instruct counsel if you wish.  Where the court hearing is further afield we can arrange representation for you.

We can also work with you to try and find a resolution to your dispute and avoid going to court if possible, and where appropriate can advise on suitable methods of alternative dispute resolution, including mediation, arbitration and expert determination.

In the event that you are faced with a defence which we consider has no merit, we can make the necessary application to court to have the matter disposed of at an early stage, avoiding the need to waste valuable time and money attending trial later.

We advise on all aspects of debt collection such as:

  • Letters before action (same working day as instructions received).
  • Issuing County Court and High Court Proceedings
  • Seeking judgment at the first available opportunity
  • Service of Statutory Demands
  • Presentation of Bankruptcy and Winding Up Petitions
  • Validation Orders
  • Instructing High Court Enforcement Officers and County Court Bailiffs
  • Applying for Charging Orders and Orders for Sale
  • Attachment of Earnings Orders
  • Third Party Debt Orders
  • Attending court

We also advise on terms and conditions, and interest claims, together with the enforcement of Retention of Title clauses.  We will discuss our fees and budgets with you for our debt collection service at the outset as our service is tailored to each client's needs.
