County Court Success for Rogers and Norton’s Construction Team


Our Construction Team, led by Peter Hastings and supported by Lauren Nelson-Smith,  successfully secured judgment in favour of our national property client in a construction dispute.

The case concerned a construction contract for the supply and installation of facilities at a residential property. Work was delayed due to the Government’s Covid-19 lockdown measures, and the Defendants attempted to cancel the contract outside the permitted cancellation period – breaching the Terms and Conditions. As a result, our client issued, as a last resort, court proceedings.

The Defendants alleged that they cancelled their contract due to defects in the materials and pleaded various sections of the Consumer Rights Act in their defence. The allegations were denied and it was made clear that our client would have undertaken any necessary works had they been allowed. The refusal, we argued, was a breach by the Defendants. Expert evidence supported the quality of works, reinforcing our client’s position.

The Judge ruled in our client’s favour, awarding judgment for the full claim, interest and costs. He accepted that the work was satisfactory.
