Domestic Abuse Awareness Month 2023
For over 30 years, October has been known as “Domestic Abuse Awareness” month. Sadly, domestic abuse is a very prevalent issue in today’s society and something that we see often in Family Law Proceedings is both party’s making allegations of abuse against their ex-partner, or when a client doesn’t actually realise that they have been a victim of abuse.
Domestic Abuse takes many forms, and thankfully we are now at a stage where this is recognised by the Courts and professionals and support is widely offered by various charities and mental health professionals throughout the UK.
Controlling and Coercive behaviour was recognised as a “discrete crime” in December 2015, which was pivotal in the support for victims of domestic abuse. As an example, Sally Challen who was convicted of her husband’s murder in 2011, appealed her conviction given the abuse she had suffered in the relationship upon the recognition of controlling behaviour as abuse. Her conviction was reduced to manslaughter and she was released from prison in April 2019 after serving a reduced sentence.
