Injunction Success
Last month, the litigation team successfully obtained an interim injunction in the High Court on behalf of its clients to prevent a mortgagor from exercising its powers of sale of the clients’ property under a legal mortgage.
The mortgagor alleges that the sum of over £1.2 million is due under a facility agreement between the mortgagor and our client’s company. Our clients dispute the sum claimed by the mortgagor alongside disputing the validity of the mortgage and a guarantee. The Court accepted our clients’ arguments and granted the injunction.
The injunction will remain in place pending a hearing for a claim that our clients have brought against the mortgagor where they are seeking a final injunction, a declaration that the obligations under the guarantee are discharged, as well as seeking damages.
