More Success for Rogers and Norton’s Litigation and Dispute Resolution Team


Following the commercial litigation team’s recent successes defending businesses in the financial sector who faced allegations of fraud and mis-selling, the team has again recently had more success in defending an action brought against one of its clients, this time relating to the alleged mis-selling of finance connected with commission payments.

An allegation was made against our client that it failed to disclose payment of commission to a broker when arranging a credit agreement.

The Claimant relied on the case of Wood –v- Commercial First (2021) which related to the contractual or other legal duty to provide information in relation to an allegation or bribery or secret commissions.

Our client, the Defendant asserted that no commission payments were made.

An application was made to strike out the claim under Civil Procedure Rules 3.4 and CPR 24.2 with supporting evidence which was very compelling. Having issued the Application, the Claimant’s solicitors discontinued the claim.
