Proposed probate and Court of Protection fee increases: what you need to know


The Ministry of Justice (MoJ) has announced proposed increases to a number of fees charged by HM Courts and Tribunals Service (HMCTS). If approved by Parliament, the changes are expected to come into effect from 13th of July 2026.

For those dealing with the administration of a loved one’s estate or making applications through the Court of Protection, these changes may affect the costs involved.

The key proposed changes include:

  • Probate application fees are expected to increase from £300 to £526. The MoJ has said this reflects inflation and investment in the Probate Registry, including improvements to its online systems and services.
  • If a probate document is requested at the same time as a probate application, the current fee of £16 is proposed to reduce to £2.
  • The cost of applying for a duplicate or second grant of probate is expected to increase slightly, from £21 to £22.
  • Court of Protection fees are also proposed to increase. The application fee for starting proceedings is expected to rise from £421 to £432, with hearing fees increasing from £259 to £266. The cost of obtaining copy documents is also proposed to rise from £5 to £8.

These increases are part of wider changes to HMCTS fees, with many charges being adjusted to reflect inflation. For families already managing the practical and emotional challenges of bereavement, or supporting someone who is unable to make decisions for themselves, changes to official fees are an important consideration when planning ahead.
