Court Success for Rogers & Norton’s Construction Team
Our Construction Team has successfully obtained judgment for a client who instructed a builder to undertake a refurbishment of a property.
The builder had taken monies in advance, failed to undertake works and failed to undertake works to an acceptable standard. The Team advised our client that the breaches were so serious that they amounted to a repudiatory breach of contract and issued proceedings for damages and compensation.
The Claim was defended, and a counterclaim issued for non-payment and loss of profit. We advised that the Defence and Counterclaim had no merit.
Our assessment of costs of repairs and completion had 5 elements, some of which include:
- Remedial works and completion of project
- Demolition costs: demolition reconstructed:
- Roof repair works
The Judge awarded judgment for our client for circa £95000 plus general damages for stress, loss of amenities and inconvenience (£6000 circa). We also beat the Part 36 Offer to settle and obtained a judgment for additional interest and costs.
Our client was delighted with the Judgment having endured a very traumatic time caused by the builder’s failings.
