Major Success for Rogers & Norton’s Dispute Resolution Team
Our Dispute Resolution Team has successfully resisted a large claim against a client, who faced allegations of breaching a fiduciary obligation of trust and confidence as well as express contractual obligations within the employment contracts and associated restricted covenants.
It was alleged in particular that our client had induced a breach of covenants leading to alleged losses approaching £1 million.
We robustly rejected all allegations, and asserted that our client had not induced any breaches and that our client did not owe an obligation of trust, and in any event there was no breach.
We advised our client that the covenants were not enforceable and that the Claimant could not prove that any loss had been sustained. As a result of our team’s dedication and expert legal advice, the Claimant eventually abandoned their claim.
