Rogers & Norton Delivers Workshop for Norfolk Construction Company on Principal Designer Responsibilities

On Wednesday 23rd October, Peter Hastings, Director and Head of the Construction Team at Rogers & Norton Solicitors, delivered an insightful workshop to staff members and key contacts of a Norfolk-based construction company. The session focused on the essential role of the Principal Designer in construction projects, as well as the legal implications and insurance considerations that come with this responsibility.

The workshop addressed several key questions raised by the company, including:

  • Understanding the definitions and duties of a Principal Designer under CDM 2015, with an emphasis on health and safety risk management during the design phase.
  • Mechanisms for directing clients without a Contract Administrator (CA) in place.
  • The implications of being named Principal Designer on a building control application and how it affects legal and insurance obligations.
  • Clarifying when a construction company becomes the Principal Designer in small projects without an architect or CA.
  • Adjudication and issues arising from contracts and scope of works, providing guidance on how to navigate disputes effectively.

Peter’s expertise provided valuable clarity to the attendees, ensuring they are better equipped to handle their legal responsibilities and reduce risks associated with construction projects.
