Success for Rogers & Norton’s Intellectual Property Team
Our Intellectual Property Team, led by Peter Hastings and supported by Jacob Cook and Abby Kerswill, obtained a successful result in a claim for the infringement of the brand name of our national client.
Our client purchased a company, including its Intellectual Property and Assets, in May 2024. The infringing company was incorporated in July 2024, trading under an almost identical company name. The company name used by our client had become distinctive and well-known in the home improvement market and had at all times become associated with the business run by our client.
A significant portion of our client’s business arose from word of mouth or recommendations so there was a serious risk of damage to this if the infringing company continued to trade. Our team was also concerned that the infringing company would be benefiting from our client’s promotion and marketing.
We assisted by applying to the Company Names Tribunal to challenge the name of the infringing company. Our team expertly liaised with the Company Names Tribunal and adhered to all deadlines. Our team’s perseverance resulted in the infringing company changing their name to one that is no longer offending our client’s intellectual property. This prevented the need for further court proceedings, saving our client costs and preventing further infringement of their brand name.
