Success on a Financial Ombudsman Claim
Further success has been achieved by our Commercial Litigation Team in acting for a UK Financial Services Business, maintaining our 100% record.
A fairly serious complaint was made to the Financial Ombudsman relating to the satisfactory quality of goods supplied under a Conditional Sale Agreement. The Complainant alleged that our client had failed to act in accordance with the Financial Conduct Authority’s code of conduct, referring to Rule 4: ‘You must observe proper standards of market conduct’ and Rule 6: ‘You must act to deliver good outcomes for retail customers’.
Our client contended that it has acted properly, and we provided a detailed response with evidence. The Complainant claimed damages. The Ombudsman concluded that our client acted in the best interests, in line with the relevant law, specifically in accordance with the Consumer Rights Act 2015 and responded quickly and efficiently meaning that the hirer was put to no loss and inconvenience and the matter was dealt with in a swift and reasonable manner. No compensation was due to be paid.
Our client was praised for their prompt action and that they had delivered the only possible outcome to the Complainant.
This is a good result for both the team at Rogers and Norton and our client in what was a long and lengthy investigation process by the Financial Ombudsman who concluded that the complaint was dealt with in accordance with The Consumer Rights Act 2015 and the Financial Conduct Authority’s code of conduct.
