In April 2022, the law was updated to allow couples to apply for a No-Fault Divorce, removing the need to assign blame or provide specific grounds for the breakdown of a marriage.
Under the new law, a divorce can be granted based on the irretrievable breakdown of the marriage without having to cite one of the previously required grounds, such as Adultery, desertion, separation for two years with consent, separation for five years without consent and unreasonable behaviour
These changes simplify the divorce process, aiming to reduce conflict and encourage more amicable separations. Couples can now apply for a No-Fault Divorce either individually or jointly.
Key Changes in the Divorce Process:
- Eligibility: You must have been married for at least one year before applying for a divorce.
- Application Timeline: The entire No-Fault Divorce process typically takes around six months to complete.
- After submitting your application, there is a 14-day acknowledgment period for the other spouse.
- A 20-week waiting period follows before the Conditional Order (formerly known as the Decree Nisi) is granted.
- Finally, after a 6-week cooling-off period, the Final Order (formerly the Decree Absolute) is issued, officially ending your marriage.
